يتضح من التعريف الوارد في المادة »1« من اتفاقية 1951م وبرتوكول 1967م أنه يشرتط لاكتساب صفة الالجئ توافر الرشوط الاتية
: 1 ـ أن يتواجد الشخص خارج البلد الذي حيمل جنسيته، أو بلد اقامته املعتادة إذا كان هذا الشخص من عديمي الجنسية.
«The Government considers that Christian Turkish nationals have no Well-founded grounds to fear persecution in their homeland within the meaning of the Geneva Refugees Convention. The application made by Turkish christian for the grant of refugee status have, therefore, been dismissed without exception (NYIL, 1985, P. 345). 4
